\nBetween the F\u00e9d\u00e9ration Cynologique Internationale (FCI)<\/strong><\/p>\n

and the<\/p>\n

Verband Kleine M\u00fcnsterl\u00e4nder \u2013 International (KlM-I)<\/strong><\/p>\n

December 7, 2006<\/p>\n

\nPreamble<\/strong>
\nThe F\u00e9d\u00e9ration Cynologique Internationale \u2013 hereafter called \u201cFCI\u201d \u2013 is the leading global federation of kennel clubs for the breeding and training of dogs of all breeds.\u00a0 It is based in Thuin, Belgium.\u00a0 Under the terms of Article 1 of its statutes, the FCI is subject to Belgian law.\u00a0 Its members are national kennel clubs, which are to implement the goals of the FCI, as specified in its statues, at the national level.\u00a0 <\/p>\n

The Verband f\u00fcr Kleine M\u00fcnsterl\u00e4nder \u2013 International (International Small Munsterlander Club) \u2013 hereafter called \u201eKlM-I\u201c \u2013 strives to globally oversee the breed it represents, the Kleine M\u00fcnsterl\u00e4nder, on the basis of its statutes and the FCI Standard Nr. 102.\u00a0 The KlM-I has its headquarters in N\u00fcrnberg.\u00a0 All national breed clubs of the Kleine M\u00fcnsterl\u00e4nder can become members of KlM-I, as long as they provide supervision of this breed through their statutes on the basis of FCI Standard Nr. 102.<\/p>\n

Both contracting partners intend to support each other in all areas related to the breed and conclude the following agreement for this purpose.<\/p>\n

\u00a7 1 Legal Framework<\/strong>
\n1.\u00a0\u00a0 \u00a0The parties commit themselves to exert influence to achieve the goals of this contract according to \u00a7 2 in the FCI, in its bodies, institutions and member clubs, on the one hand, and in the KlM-I with its bodies, institutions and member clubs, on the other hand.
\n2.\u00a0\u00a0 \u00a0Through the conclusion of this cooperation agreement, KlM-I acquires no member rights in the FCI and cannot acquire such member rights in the future.\u00a0 The membership in the FCI is solely reserved for national kennel clubs.
\n3.\u00a0\u00a0 \u00a0Through the conclusion of this agreement the FCI acquires no member rights in KlM-I and cannot acquire such member rights in the future.\u00a0 The membership in KlM-I is reserved for national breed-specific clubs.
\n4.\u00a0\u00a0 \u00a0FCI and KlM-I recognize and respect the clubs and associations which are combined in their respective organizations.
\n5.\u00a0\u00a0 \u00a0KlM-I will encourage its member clubs to be members of the FCI member associations in their respective countries.\u00a0 This applies, however, only to countries in which the FCI has accepted a canine organization as a member.
\n6.\u00a0\u00a0 \u00a0The FCI will sign such a cooperation agreement with only one international club per breed.<\/p>\n

\n\u00a7 2 Common Goals<\/strong>
\nBoth contracting partners intend to realize the following canine goals within the framework of this agreement:
\n1.\u00a0\u00a0 \u00a0Implementation and compliance to the global applicability of the FCI standard for the breed overseen by KlM-I in accordance with the standard requirements of the land of origin of the breed;
\n2.\u00a0\u00a0 \u00a0Global compliance with the breed standard character and performance requirements;
\n3.\u00a0\u00a0 \u00a0Global preservation of performance utility;
\n4.\u00a0\u00a0 \u00a0Global compliance with the health characteristics required for the breed;
\n5.\u00a0\u00a0 \u00a0Cooperation in fundamental canine questions, particularly in matters of national or international political significance;
\n6.\u00a0\u00a0 \u00a0To formulate the aforementioned goals, in as much as these need detailed regulation, in a breed-specific supplemental agreement.<\/p>\n

\u00a7 3 Admission of new members<\/strong><\/p>\n

    \n
  1. \u00a0Both contracting partners are committed to insure that member clubs of KlM-I will be admitted as members of FCI, in that these clubs acquire membership in the relevant national kennel clubs of the FCI.
    \n2.\u00a0\u00a0 \u00a0In order to coordinate future canine interests, the parties will mutually inform themselves about the respective national situation, before admitting new kennel clubs by FCI or breed specific member clubs by KlM-I.
    \n3.\u00a0\u00a0 \u00a0In this connection, the parties state their willingness, to share existing contacts in those countries, in which the other contract partner is not yet present, in order to expand their respective sphere of influence through mutual support and assistance.<\/li>\n<\/ol>\n

    \n\u00a7 4 Solving Problem Areas<\/strong><\/p>\n

    Both contracting partners realize that there can be problems between the existing organizations in exceptional cases.\u00a0 These can be based primarily on differences at the national level and have quite different causes.\u00a0 The contracting partners express their intention to do everything possible to solve problems like this by mutual consent.\u00a0 If a cooperative solution cannot be quickly reached, however, in spite of efforts by both sides, both partners will temporarily exclude individual problems and continue their cooperation unchanged.<\/p>\n

    \u00a7 5 Effectiveness, Term and Liquidation<\/strong><\/p>\n

    This agreement goes into effect with the signing of the agreement by both parties.\u00a0 It remains in effect until one of the parties delivers a written notice of termination.\u00a0 In this case, the agreement is ended six months after receipt of the notice of termination. \u00a0<\/p>\n
